  1. Upon enrolment through Bookeo you accept and acknowledge the following terms and conditions set out below 

  2. You accept that gymnastics is a dangerous sport with inherent risks associated and by enroling in any class, event or holiday camp with Gymkidz you acknowledge all risks involved thereof. Gymkidz takes no responsibility for any personal injury, damage to property, loss or liability suffered by any participant or any participant’s parent or guardian in connection with or arising from the enrolment and/or participation in any Gymkidz class, due to any cause whatsoever.

  3. In the event of an illness or accident, you authorise Gymkidz to seek any medical, hospital or ambulance services as we see fit, should we be unable to get in contact with you and you agree further to meet all expenses involved.

  4. Gymkidz reserves the right to make changes to any coaches without notice.

  5. In the event of a disruptive participant who presents a disciplinary problem that continues affecting the experience of other gymnasts involved, Gymkidz reserves the right to refuse, suspend or terminate participation.

  6. Should you be unable to attend a class, you will be entitled to three make-up class per term, subject to availability.The makeup classes must take place in the same term as the missed classes. Makeup classes are subject to availability and fees will not be refunded or credited where a student is unable to find a convenient makeup class.

  7. Cancellation of your enrolment ten days prior to the start of the term, will entitle you to a refund less an administration fee of up to $10. Should an enrolment be cancelled once the term has commenced, we require one months notice and a refund for remaining classes will be provided. This applies for all circumstances including cancelation arising from illness or injury occurring outside Gymkidz classes. No refunds are available for holiday camp fees, casual classes or playtime classes. 

  8. The annual Insurance Registration Fee of $30 is a non-refundable payment and is applicable to each calendar year. 

  9. Should you book into a class and attend without making payment, Gymkidz reserves the right to debit your account after sufficient notice has been given. 

  10. You acknowledge that Gymkidz retains all enrolment information on a confidential database. You authorise Gymkidz to use this information to communicate with you and send marketing and promotional information on occasion.

  11. Security and Privacy Statement:Information collected by Gymkidz is personal information, as defined by the Privacy Act 1998. This data includes your first name, last name, email address, telephone number and postal address. This information is used to identify yourself when making an online enrolment, to contact you about an enrolment, class details and in the event of an emergency and to keep you informed, should you request this, to be included on matters that may be of interest to you. Personal information is not used for commercial purposes or distributed in any way or to, any other organisation, for any purpose.

  12. You agree to allow Gymkidz the use of photographs of you/your child for marketing and publicity purposes unless you explicitly request otherwise.

  13. Gymkidz may amend these terms and conditions at any time at its discretion. Any changes will be communicated and will be effective immediately.

Refunds, Dispatch and Deliveries Policy

 

Refunds Policy:

 

1. Cancellation of your enrolment ten days prior to the start of the term, will entitle you to a refund less an administration fee of up to $10. Should an enrolment be cancelled once the term has commenced, we require one months notice and a refund for remaining classes will be provided. This applies for all circumstances including cancelation arising from Covid, illness or injury occurring outside Gymkidz classes. No refunds are available for holiday camp fees, casual classes or playtime classes. The annual Insurance Registration Fee of $30 is a non-refundable payment and is applicable to each calendar year.

2. Should you wish to cancel your Gymkidz Birthday Party booking, you will be entitled to a refund of your deposit less an administration fee of up to $10, provided that no less than one months notice is given. This applies for all circumstances including cancelation arising from illness or injury occurring outside Gymkidz classes. 

 

3. Should you book into a class and attend without making payment, Gymkidz reserves the right to debit your account after sufficient notice has been given. Refunds are usually processed within 14 business days. All refunds must be issued to the original purchaser. Refunds will incur a $10 fee. All refunds must be issued to the original purchaser.

 

Dispatch and Deliveries Policy: ​

 

All Gymkidz products are delivered via Australia Post Regular Post service. Postage will be calculated at checkout; an additional charge will be incurred for buyers requesting express delivery. We will endeavour to have your order in the post within 10 working days of placing it. Please ensure that you provide a valid delivery address. Where a valid address is not provided the purchaser will bear the expense to have the goods re-delivered.

  1. The promoter is Gymkidz (ABN 15917517165), conducting business at Coronation hall, 95 Lennox street, Newtown, 2042, NSW

  2. Information on prizes and how to enter Gymkidz competitions form part of these Terms & Conditions of Entry.

  3. By entering Gymkidz competitions, entrants accept the above-stated Terms & Conditions of Entry.

  4. The competition is open to all persons living in NSW with a child between the ages of 18 months to 8 years, to be eligible to win a prize

  5. All entries must be submitted as advertised, by the advertised closing time and date

  6. Late, illegible, incomplete, defaced or corrupt entries may not be accepted and no responsibility will be accepted for lost entries.

  7. Inappropriate comments including but not limited to those depicting nudity, violence, unsafe activities, substance abuse or misconduct will not be accepted

  8. Prize winners are selected by Gymkidz and winning entries are selected based on creativity.

  9. The decision of the judges is final and binding. As such, no correspondence will be entered into.

  10. Winning entries will be published on Facebook and Instagram on the specified closing date and time of the competition and the winner will be contacted privately within 5 business days of the closing date and time of the competition, to claim the prize

  11. Unless expressly stated, all other expenses become the responsibility of the winner.

  12. If any prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.

  13. Subject to the unclaimed prize draw clause, if for any reason a winner does not take the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.

  14. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the prize except for any liability which cannot be excluded by law.

  15. As a condition of accepting the prize, the winner (and his/her companion – where applicable) must register online and accept the Gymkidz Term and Conditions

  16. Prizes are not redeemable for cash, credit or product and no exchanges are offered. The Promoter accepts no responsibility for any variation in the value of the prize (or part thereof).

  17. The Promoter assumes no responsibility for any error, omission, interruption, corruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer networks and systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any web site, or any combination of them, including any injury or damage to any entrant's or any other person's computer related to or resulting from participation or downloading any materials in this Competition.

  18. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoters legal rights to recover damages or other compensation from such an offender are reserved.

  19. If for any reason the competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or to cancel, terminate, modify or suspend the competition.

  20. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions at a later date.
